Default Missouri Man Claims He Was Denied Adoption Because of His Weight

A Missouri man claims he's being discriminated against due to his weight,
according to MyFoxKC.com.

Gary Stocklaufer said he and his wife, Cynthia, were asked to adopt Gary's
cousin's 3-month-old son because the relative couldn't care for the boy
anymore. But a judge — the same judge who approved Gary's adoption of his
now 7-year-old son — denied the adoption on the grounds of Gary's weight,
Stocklaufer said.

The real question in this case is who *is* going to watch out for the
child? Quite frankly, I think that the judge is over-stepping some
boundaries.

I went out and watched the video at the website. The guy is 500 pounds and
the judge was worried about his health complications, which *happen* to be
weight related. I don't see that this guy was turned down "just because he's
overweight". I don't think that a person's weight effects what's inside
their mind and soul, BUT, this guy is handicapped by his weight and the
judge probably figured he wasn't physically fit or healthy enough for
day-to-day parenting.

On another note, I'm not aware of any law prohibiting descrimation against
people based on their weight. There are laws agains sexual, racial and
religous descrimination, handicap, national origin, etc. But if a person
applies for a job, "we won't hire you because you weigh so damn much," is
just the same as saying, "we don't want to hire you because you're gay."
Right, wrong or indifferent, that's the law.

Yah, he can drive a truck. I call bullshit on not stopping him from playing
with his son. Maybe he can roll around on the floor to play with toys and
board games, but I can't see this guy keeping up with a seven year old, for
two minutes, out on a playground, much less having the ability, g-d forbid,
to rescue that boy from just about any perilous sitution.

G-d bless them! They guy has already lost 35 pounds. If he keeps at it and
continues to lose weight, he might get the kid. That'd be great!

The word in the newsgroup title is "weights", as in weights that you
lift, not what someone weighs when they step on the scale.

Discrimination is perfectly legal if it is NOT one of the protected
classes such as race religion etc. Weight is not a protected class
so the judge is within his rights to use that in determining what is
in the best interest of the child.
